“You Are Hereby Served” – Congress Committee Subpoenas FBI for Hillary Clinton’s Emails

In a bold move, the chairman of the United States House Committee on Oversight and Government Reform, Jason E. Chaffetz, yesterday issued an on-the-spot subpoena to top Federal Bureau of Investigations (FBI) officials, demanding the release of all emails relating to Hillary Clinton’s tenure as U.S. Secretary of State.

Re-asserting the authority of the House Committee over the FBI in matters of government oversight, Chairman Chaffetz told the Bureau’s Acting Assistant Director for Congressional Affairs, Jason Herring, that he wants — and has the Constitutional right — to see every piece of the FBI’s investigative file, not just pages cherry-picked by the Bureau.

Addressing FBI Assistant Director Herring, Chaffetz stated: “You don’t get to decide what I get to see — I get to see it all. I was elected by some 800,000 people to come to Congress and see classified information. I was elected by my colleagues to be the Chairman of this Committee. That’s the way our Constitution works. Will the FBI provide to Congress the full file, with no redactions..?”

When Herring refused to “make that commitment”, Chaffetz continued without hesitation, “Then I’m going to issue a subpoena, and I’m going to do it right now… You are hereby served.”

Chaffetz’ unprecedented action reflects a growing frustration within the House Oversight Committee with the FBI’s lack of cooperation in duly investigating and reporting facts relating to FBI Director James Comey’s decision not to indict Mrs. Clinton. On Monday, the House also dressed down Assistant Director Herring who was unable to explain the FBI’s reluctance to hand over full copies of their investigation documents to Congress, nor his notable absence last week from an important House meeting on the matter.

Tellingly, key Clinton aide Bryan Pagliano, who set up and maintained Mrs. Clinton’s private email server and mobile devices, ignored a subpoena to attend the House hearings, pleading Fifth Amendment protections against self-incrimination — despite already being granted legal immunity by the FBI. Two other witnesses linked to Clinton’s email server also invoked the Fifth Amendment, and repeatedly refused to answer questions.

Are FBI Officials Covering for Mrs. Clinton?

Last year it was revealed that Clinton knowingly and secretly maintained a private email server in New York for all of her State Department email business, including the exchange of classified information, in contravention of U.S. government cyber-security protocols. She then failed to turn over many of those private emails to the State Department when she left the position in 2013 — as she is required to do by law — and has subsequently refused to do so.

FBI investigations into Clinton’s dubious actions were concluded earlier this year, with no action taken against her by Bureau investigators — despite mounting evidence of misconduct and unlawful activity. Given the lack of transparency on the part of Clinton in her role as Secretary of State, and of the FBI in its investigation, the handling of this issue has raised serious questions of a deliberate cover-up by authorities — questions which have so far not been adequately answered by the Clinton or FBI investigators. This has led many to believe the Bureau is shielding her from proper regulatory oversight and potentially, criminal prosecution, raising further questions of senior FBI officials, who have no reasonable cause to withhold evidence from the House Committee — unless they too have something to hide.

The FBI has so far released only two documents relating to the Clinton affair, a 47-page summary of their investigations and an 11-page summary of an interview with Clinton – both released on the Friday afternoon before the Labor Day holiday weekend. FBI Director James Comey has since defended the questionable timing of those releases, as well as the Bureau’s insistence on editing the information provided to Congress, and its decision not to indict Mrs. Clinton in this matter. However, as Members of the House Committee have stated, the documents provided by the FBI “did not constitute a complete investigative file”, leaving the House Committee no option but to subpoena the Bureau and asserting its authority in matters of Congressional oversight.

Meanwhile, growing numbers (both from within Congress and the general public) believe Mrs. Clinton’s deliberate mishandling of classified information should automatically disqualify her from the presidential race, irrespective of the outcome of the FBI’s (questionable) criminal investigations.

Hillary Clinton has so far made no public comment on the matter.
